Our client James, a store manager at a Trader Joes near Atlanta, was out in the store’s parking lot directing traffic while a tractor trailer truck was delivering good to the
store. He was wearing a bright red shirt and was 6’3’’ tall. While directing traffic, a lady who was not paying attention backed her car out of her parking space and ran over his foot and ankle causing severe injuries that eventually required surgical repair. The case was fought heavily by the insurance defense attorneys. First, they blamed James for standing behind the parked car when the Defendant backed out. Then, they hired an expert who testified that the pain in James’ ankle was unrelated to the car driving over him and instead said his pain was from a “slow-growing hereditary mass.” We were able to overcome those challenges and obtain an excellent settlement for James. This case was referred to us from another attorney for us to handle the litigation.

Charles was an experienced motorcycle ridder and bike mechanic. After tuning up his bike one evening in January, he took the motorcycle out for a test run around his
block. Charles left his house in Cobb County and proceeded to make a series of right hand turns to quickly test the bike’s stability then take it back to his house. Charles made his last right-hand turn onto Robinson Road when he discovered that a pick-up truck was sitting in the middle of the intersection blocking all traffic. Charles’ only possible reaction was to lay the bike down. Luckily, he was wearing a helmet and full bike padding. That didn’t prevent the concussion and loss of consciousness he sustained when his head bounced off the concrete. Charles suffered a minor brain injury and had to seek therapy. The insurance company that covered the at-fault driver quickly paid its minimum coverage. Unfortunately, Charles’ own underinsured motorist policy through State Farm fought the claim and blamed Charles saying he had the “last clear chance” to avoid the collision by navigating his motorcycle between the narrow gap between the curb and the rear of the truck. We litigated the case and were
able to get it resolved at mediation.
