Our client James, a store manager at a Trader Joes near Atlanta, was out in the store’s parking lot directing traffic while a tractor trailer truck was delivering good to the
store. He was wearing a bright red shirt and was 6’3’’ tall. While directing traffic, a lady who was not paying attention backed her car out of her parking space and ran over his foot and ankle causing severe injuries that eventually required surgical repair. The case was fought heavily by the insurance defense attorneys. First, they blamed James for standing behind the parked car when the Defendant backed out. Then, they hired an expert who testified that the pain in James’ ankle was unrelated to the car driving over him and instead said his pain was from a “slow-growing hereditary mass.” We were able to overcome those challenges and obtain an excellent settlement for James. This case was referred to us from another attorney for us to handle the litigation.
